Maroc Telecom, Morocco's incumbent telecommunications operator, is expected to appear before the commercial court in Rabat on December 27 after competitor Inwi has again filed a complaint against it for abuse of dominant position.
The lawsuit was approved at its last board meeting on Monday, December 13, and filed on Thursday, December 16. Inwi is seeking U$733.1m in damages from Maroc Telecom.
This is not the first time that inwi has denounced Maroc Telecom for abuse of dominant position or unfair competition. For several years the two companies have been at the heart of a battle over the unbundling of local fibre loops and sub-loops. Inwi accuses Maroc Telecom of confiscating them.
Since June 2014 that the National Agency for Telecommunications Regulation (Anrt) has set the rules governing these infrastructures, Maroc Telecom has not complied. Several injunctions have been addressed to it but without success. The company has always claimed that the fibre optic loops and sub-loops are the result of its investments.
